Welcome to ShiftQuality. These Terms & Conditions ("Terms") govern your access to and use of www.shiftquality.com and any content, articles, learning paths, templates, checklists, and other materials made available through it (together, the "Site").

 

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

 

In these Terms, "ShiftQuality," "we," "us," and "our" refer to the operator of this Site. "You" refers to anyone who accesses or uses the Site.

 

1. What ShiftQuality Is

 

ShiftQuality publishes educational content about software quality, testing, delivery, and the use of AI in engineering work. The Site is provided as a free reference and learning resource for individuals and teams.

 

The Site is informational. It is not a consulting engagement, a certification program, or a substitute for professional judgment applied to your own situation.

All content on the Site — including articles, learning paths, templates, checklists, text, graphics, layout, and design — is owned by ShiftQuality or its licensors and is protected by copyright and other intellectual property laws.

 

What you may do. You may view and read our content, print or download copies for your own personal or internal business reference, and quote short excerpts with clear attribution and a link back to the original page.

 

What you may not do. Without our prior written permission, you may not republish, redistribute, resell, or syndicate our content; reproduce it substantially in another publication, product, course, or training material; or use it to train, fine-tune, or otherwise develop a machine learning or AI model.

 

Templates and checklists. Downloadable templates and checklists we make available are licensed to you for use within your own organization. You may adapt them for internal use. You may not sell, license, or distribute them as your own product or as part of a paid offering.

The Site links to and cites third-party websites, standards bodies, tools, publications, and other external sources. Those links are provided for reference and convenience.

8. Limitation of Liability

 

To the fullest extent permitted by law, ShiftQuality and anyone associated with operating the Site will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, goodwill, or anticipated savings, arising out of or relating to your use of — or inability to use — the Site or its content, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

 

Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Site is limited to one hundred U.S. dollars (US $100).

 

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted.

 

9. Indemnification

 

You agree to indemnify and hold harmless ShiftQuality and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or the rights of any third party.

Your use of the Site is also governed by our Privacy Policy, which explains what information we collect and how it is handled.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be reflected here rather than sent individually. Your continued use of the Site after changes are posted means you accept the revised Terms.

 

12. Governing Law

 

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law rules.

 

You agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the Commonwealth of Pennsylvania, and you consent to the personal jurisdiction of those courts.

 

13. Severability and Entire Agreement

 

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.

 

Our failure to enforce any provision is not a waiver of that provision.

 

These Terms, together with the Privacy Policy, are the entire agreement between you and ShiftQuality regarding your use of the Site.
